Terms and Conditions for Online Purchases

• By placing an order with Switchon.co.in, you are accepting these Terms & Conditions. Please read before placing an order.
• By using the website to buy products online, you confirm that you are at least 18 years old.

Ordering

• Please note that products will not be sent (or links to online products) until we have authorization from your payment card issuer.
• We will not be liable if there is a delay, and we will not accept your order if payment is not authorized.

Certain steps must be followed for a contract to be formed, as described below.

Placing an order:

• You will receive an email to acknowledge your order. It will confirm which products you have ordered. This email is not an order acceptance from us.
• When an order has been you will be redirected to a ‘thank you’ page which will require you to verify your name and address.
• Once that information has been verified check out page will appear and you have to make payment via debit/credit card (all major bank cards are accepted) or net banking.

We will not accept your order if:

• Switch On reserves the right to cancel any order placed which is not available, out of stock or in short supply.
• Pricing on any product(s) as is reflected on the Website may due to some technical issue, typographical error or product information published by seller may be incorrectly reflected. Any order placed for a product that is listed at an incorrect price may be cancelled. This shall be regardless of whether the order has been confirmed and/or payment levied. In the event the payment has been processed, the same shall be credited to your account and duly notified thru e-mail.
• In a credit card transaction, you must use your own credit card. Switch On will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the on us to ‘prove otherwise’ shall be exclusively on the user. To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In the event of detecting any suspicious activity, Switch On reserves the right to cancel all past, pending and future orders without any liability.
• Switch On is not responsible for non-delivery, unsatisfactory or delayed performance of services or damages or delays as a result of items which are out of stock, back ordered or otherwise unavailable. All items are offered only for a restricted time and only for the available supply. It is our responsibility to dispatch the Product to the User (depending on the Product or Offer Price). Any request for cancellations of orders once duly placed on the site, shall not be entertained.
• In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost towards re-delivery shall be claimed from you.
• Shipment/delivery time of order processing starts from the day of receipt of the payment confirmed against the order placed with Times Internet Limited. Switch On shall not be liable for any delay / non-delivery of purchased goods due to any force majeure event including but not limited to flood, fire, wars, acts of God or any event beyond the control of Switch On.
• You agree to receive calls from Switch On and its agents, merchants, courier partners seeking clarification/information regarding your order and any other related information as and when required and disclaim any liability of Switch On in this regard
• All prices and availability of products are subject to change without prior notice at the sole discretion of Switch On.

Cancelling an order before the product has been sent

• If you change your mind after placing an order, you can cancel it at any time before we send it.

• You will need to give us your name and address details, as well as your order number to cancel your order.

Pricing and payment

• Prices throughout the website are quoted in Indian Rupees. Packing and delivery costs, if any, will be added to the total price of your purchase.
• While we make every effort to ensure that the products shown on our website are currently available at the price shown, we cannot guarantee that this will always be the case.
• If products you have ordered are unavailable, you will be notified as soon as possible.
• The price you pay is the price of the products shown at the time you place your order, even if the price of the product has since changed.
• Your payment card will be debited for your order at the time the order is placed.
• By submitting an online order with switch on, you expressly agree not to request a ‘charge back’ of any fees or payments for said orders, and that no dispute with switch on will be raised with or adjudicated by the credit card company. Rather, you agree to contact Switch on directly to resolve the issue or obtain a refund.
• Where an offer mentions that an item is reduced in price, e.g.: half-price, the discount will be calculated at checkout before any postage or packaging charges are applied.

Delivery information & Delivery Process

• The buyer confirms their order with us via e-mail.
• The buyer needs to settle full payment prior to the release of the order.
• Buyer’s shipping address; pin code will be verified with the database of Website before a Buyer proceeds to pay for Buyer’s purchase. In the event Buyer’s order is not serviceable by logistic service providers or by Seller or the delivery address is not located in an area that is covered under the order confirmation form, Buyer may provide an alternate shipping address on which the Product can be delivered by the logistics service provider or by the Seller.
• Please note that there is no guaranteed dispatch time and any information about the dispatch time is estimate only and should not be relied upon as such. Therefore, time is not the essence of the bi-partite contract between the Buyer and the Seller for purchase and sale of Product on or through the Website. However, the Product shall not be delivered to the Buyer unless the Buyer makes the payment of the purchase of Product.
• The title in the Products and other rights and interest in the Products shall directly pass on to the Buyer from Seller upon delivery of such Product and upon full payment of price of the Product. Upon delivery, the Buyer is deemed to have accepted the Products. The risk of loss shall pass on to the Buyer upon delivery of Product.
• For products that require shipping, we will email you as soon as your order has been shipped, and will advise of the shipping method (if any) at that time.

Changes to Terms & Conditions for buying products online

• We reserve the right to change these Terms & Conditions for buying products online from time to time. If this happens, we will notify you by posting the new Terms & Conditions for buying products online on the website.
• If you do not wish to be governed by the revised Terms & Conditions for buying products online, you must not place any further orders.
• These Terms & Conditions for buying products online are governed by the law of the India. If any part of these Terms & Conditions for buying products online is found to be invalid by law, the rest of them remain valid and enforceable.
